By accepting these Terms & Conditions of ROCKPOOL Health Sdn. Bhd. (operator of the myFIT app), I acknowledge and agree to the following. I understand that myFIT is a platform that enables me to book classes offered by independent fitness providers, including different brands and studios (“Studios”). I further understand and acknowledge that my participation in any fitness activities and use of equipment at these Studios involves certain inherent risks and dangers. In consideration of being allowed to participate in fitness activities at myFIT, I hereby agree to the following:

 

 1.⁠ ⁠Acceptance of Terms:

By accessing and using MyFit (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Service.  

 

2.⁠ ⁠Use of Service:

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You are responsible for maintaining the confidentiality of your account credentials.  

You agree not to use the Service in a way that could damage, disable, overburden, or impair it.

 

3.⁠ ⁠Bookings and Payments (No refund):

Bookings are subject to availability.

Payment for bookings must be made in accordance with the payment methods provided for the Service and is non-refundable (credits or otherwise).

Credits purchased through the service may be subject to expiration. Please see the credit plan details for more information.

Cancellation policies vary and are specified at the time of booking.

All prices are subject to change without notice.

 

4.⁠ ⁠Attendance and Conduct:
Students are expected to arrive on time for classes or no later than 10 minutes after the start time. MyFit reserves the right to refuse service to anyone.
Disruptive behavior will not be tolerated.

 

5.⁠ ⁠Intellectual Property:

All content on the Service, including text, graphics, logos, and images, is the property of MyFit and is protected by copyright laws.

You may not reproduce, distribute, or modify any content from the Service without express written permission.

 

6.⁠ ⁠Waiver of Liability:
MyFit shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service.
You understand that fitness activities may involve strenuous physical exertion, and you voluntarily assume full responsibility for any risks, injuries, or damages (caused by you or someone else) that may occur as a result of your participation in the classes.

MyFit is not responsible for any injuries, risks and/or damages that may occur during classes.

You release, waive, discharge, and unequivocally agree not to hold MyFit (owners, instructors, employees, and affiliates) liable for any risks, injuries, or damages as a result of your participation in the classes.

You shall inform the instructors and staff of any current or past injuries before the start of the classes, and you shall practice extra caution throughout the class. You further undertake to stop your participation in the classes immediately if you feel any discomfort of pain as a result of your participation in the classes.

 

7.⁠ ⁠Changes to Terms:

MyFit reserves the right to modify these Terms at any time.

Any changes will be posted on the Service, and your continued use of the Service constitutes acceptance of the modified Terms.

9.⁠ ⁠Credit plans:

Credits purchased from the credit plans, may have expiry dates. Please read the credit plan details.

Any credit adjustments made by the admin, are also subject to the terms and conditions.

 

10.⁠ ⁠Favourites:

Students can set favourite brands and locations.

MyFit reserves the right to remove any favourite, that breaks the terms of service.

 

11.⁠ ⁠Booking logs:

Booking logs are kept for auditing and tracking purposes.

 

12.⁠ ⁠Severability

If any of the terms and conditions are found to be invalid or unenforceable, the remaining terms and conditions will continue to be fully effective.
